When does information stop being confidential? The Court of Appeal has handed down an important judgment on the meaning of "public domain" in commercial agreements - confirming that information can remain confidential even if it has been shared with a limited audience. The decision offers valuable guidance for businesses using NDAs, particularly where commercially sensitive strategies are involved. Charlie Wall appeared as junior counsel on behalf of Illiquidx, instructed by Quinn Emanuel Urquhart & Sullivan, LLP. More information on his practice can be found below. For decades, ADR didn't need a national platform. Today, it's a different story. Court backlogs are growing, litigation keeps getting slower and more expensive, and as more parties choose private dispute resolution, expectations for speed, technology, and breadth have never been higher. The question isn't whether ADR is growing - it's whether the infrastructure behind it keeps pace. The future of ADR is a platform that adds national reach and resources while strengthening every local firm it touches. That's the Accordia Group model. NKF to be the first Tier 1 law firm in Switzerland to roll out Legora firm-wide. This marks another important step in our ongoing commitment to innovation and the integration of cutting-edge technologies, including AI, across our firm. We continue to invest in solutions that empower our lawyers, enhance client service and help shape the future of legal practice.
Today we are partnering with Niederer Kraft Frey (NKF), one of Switzerland’s leading commercial law firms. NKF adopted a paper-free model early, built a culture of structured technology testing, and knew exactly what it needed: not just a tool, but a partner committed to real adoption. Across M&A, capital markets, investigations, and beyond, the way lawyers at NKF are now working has transformed. Querying complex documents in real time, managing large-scale data rooms, and focusing their expertise where it matters most. Full story in the comments.

Tomorrow, the United States marks Independence Day. On July 4, 1776, Congress adopted the Declaration of Independence, one of the most consequential legal documents in the nation's history. At its core, it was an argument about law: that legitimate authority rests on the consent of the governed. That principle still anchors the legal profession today. Every contract, every combination, and every courtroom depends on a system built to honor it. For the lawyers, advisors, and firm leaders who keep that system running, the day carries particular weight. MergerWatch wishes you a safe and reflective Fourth of July. We will return to regular market commentary after the holiday.
