The reported federal investigation into the Los Angeles Clippers raises an important distinction between potential violations of league rules and possible criminal conduct. Marisa Darden, Partner and Chair of Benesch’s White Collar, Government Investigations & Regulatory Compliance Practice Group, spoke with KNX News Radio Los Angeles about the investigation and reports that federal prosecutors have issued at least one subpoena related to the organization’s business relationships. Marisa explained that a subpoena does not necessarily indicate criminal activity and that violations of league rules are not criminal offenses. However, prosecutors could consider wire fraud charges if evidence of intentional fraud emerges. She also discussed what future developments could signal that the inquiry has entered a more advanced stage.
